§ 1 Validation
1.1 Upon buying an membership for the DFDF-Convention (called “convention” below) every attendee accepts these general terms and conditions.
1.2 Any change to the contract for the convention have to be made in writing.
§ 2 Contract
2.1 A contract for attending the convention is entered by registration and payment of the complete registration fee by the attendee plus the notification that the registration is approved of by DFDF (called “organiser” below).
2.2 The contract can only be cancelled withing 14 day after the conclusion of the contract. The cancellation has to be made in writing. It is not possible to cancel a contract less than ten weeks before the beginning of the convention.
2.3 It is not permissible to assign rights pertaining to the contract to a third party. An assignment of rights to a third party is only valid if it has been cleared with the organiser beforehand.
2.4The organiser reserves the right to rejegt a registration without indicating a reason. The organiser is allowed to withdraw from the contract if made aware of facts that lead to the assumption that the attendee will violate the terms and conditions in the future.
2.5 The organiser reserves the right to cancel the convention. In this case the organiser will refund the registration fee. Further claims are excluded.
§ 3 Convention/Guarantee
3.1 The organiser reserves the right to change the programme of the convention.
3.2 The organiser does not guarantee the appearance of a specified guest of honour. Should a guest of honour not attend the convention the organiser will arrange for a suitable replacement. This does not imply a right to withdraw from the contract for the attendee.
3.3 Offering and selling merchandise or services in the course of the convention is only allowed after having successfully applied to the organiser for a permission to do so. There is no general claim to this permission.
§ 4 Liability
4.1 Each attendee attends the convention at his or her own risk.
4.2 The organiser is liable only for wilful negligence and intent. Example: the organiser is liable in case any items of value got lost or damaged while being in the care of DFDF-personnel on demand of the organiser (i.e. Cameras or the like).
4.3 The attendee is liable in full for damage caused by the attendee to the property of a third party. This pertains to damages to financial loss, damaged property, personal injury and claims for compensation resulting from breaching the copyright.
4.4 The organiser is not liable for damages incurred by third parties assigned by the organiser.
4.5 The organiser does not assume any responsibility exceeding due diligence and the legal duty to maintain safety for any underage attendees or attendees who are impaired in their judgement. Underage attendees are subject to the law of the protection of the youth (Jugendschutzgesetz).
§ 5 Safety/Order
5.1 The DFDF-Committee can be recognized by the Concom-Badges. Instructions of the Committees are to be followed at all times.
5.2 The Committee is authorized to check the attendees bags during the convention.
5.3 It is strictly forbidden to bring weapons, pyrotechnics or other dangerous items to the convention. This includes items that are part of a costume. Any items that are part of a costume and could cause injuries to others have to be presented to the organiser upon entering.
5.4 It is strictly forbidden to bring any substances violating the narcotics act (Betäubungsmittelgesetz).
5.5 The organiser reserves the right to ban any sort of advertisement.
5.6 It is not allowed to bring animals into the function rooms with the exception of necessary guide dogs.
5.7 Violations of paragraph 5.1 to 5.6 are seem as reasons for dismissal and can get an attendee banned from the function rooms. The attendee has no claim on a refund. The organiser reserves the right to expel attendees from the function rooms that hinder the proceedings, show improper behaviour or pose a threat to themselves or others.
§ 6 Audiovisual Recordings
6.1 audiovisual recordings in terms of these terms and conditions are: audio-and video recordings that can be played or copied with the use of the appropriate sound/picture recording/storage medium (videos, audio recordings, photos, et cetera).
6.2 The organiser reserves the right to prohibit audiovisual recordings during certain parts of the programme. This prohibition will be announced separately. The announcement is to be heeded without delay. Nonobservance of the prohibition can lead to the destruction of the material in question. In addition the attendee can be excluded from the convention (see paragraph 5.7). The organiser reserves the right to claim a compensation.
6.3 audiovisual recordings are not to be used for commercial reasons unless the organiser has agreed to the usage in writing prior to the fact (i.e. for press material).
6.4 In cases of violation of 6.3 the organiser will hold the offending party accountable, for claims by the organiser as well as by third parties.
